Introduction
These Terms and Conditions govern the sale of vehicles and related services provided by Dragon Vans Ltd ("we", "us", "our"). By placing a deposit, purchasing a vehicle, instructing us to source a vehicle, or engaging in any transaction with us, you agree to be bound by these Terms and Conditions. These Terms and Conditions do not affect your statutory rights under applicable UK consumer protection legislation, including the Consumer Rights Act 2015.
Vehicle Availability
All vehicles advertised by Dragon Vans Ltd are subject to prior sale and availability. We reserve the right to withdraw any vehicle from sale at any time without notice. Vehicle specifications, prices, mileage, equipment, and availability may change and should be confirmed before purchase.
Vehicle Descriptions and Information
We make every effort to ensure that vehicle descriptions, photographs, specifications, mileage, service history details, and other information are accurate. However, vehicle descriptions are intended as a guide only. Customers are responsible for satisfying themselves as to the condition, suitability, specification, history, and fitness for purpose of any vehicle before purchase. Minor discrepancies, cosmetic imperfections, wear and tear consistent with age and mileage, or inaccuracies that do not materially affect the vehicle's value or performance shall not constitute grounds for rejection. Photographs may not show all features, accessories, defects, or current condition of a vehicle.
Vehicle Inspections and Test Drives
Customers are encouraged to inspect vehicles thoroughly and undertake a test drive where possible before completing a purchase. By completing a purchase, the customer confirms that they have had a reasonable opportunity to inspect the vehicle and are satisfied with its condition, subject to their statutory rights.
Vehicle Pricing
All prices are stated in Pounds Sterling (£). Unless otherwise stated, prices displayed for commercial vehicles are exclusive of VAT. Where VAT applies, this will be clearly identified. Customers are responsible for confirming whether VAT is applicable before purchasing a vehicle. We reserve the right to amend prices without notice prior to a sale being agreed.
VAT
Where applicable, VAT will be charged at the prevailing rate. Vehicles sold under the VAT Margin Scheme will not have VAT separately identifiable on the invoice. VAT-registered businesses are responsible for determining whether they are able to reclaim VAT and should seek independent accounting advice where necessary.
Administration Fee
A standard administration fee of £199 +VAT applies to all vehicle purchases. This covers the preparation of your vehicle and paperwork, HPI checks, Pre-Delivery Inspection, Valet and the administration required to ensure a smooth and efficient handover. This fee will be added to your purchase invoice and payable with the balance of the vehicle.
£250 Vehicle Reservation Deposit
Customers may reserve an advertised vehicle by paying a £250 reservation deposit. The reservation deposit removes the vehicle from sale for an agreed period to allow the customer time to arrange viewing, inspection, finance, or collection. The £250 reservation deposit is fully deductible from the final purchase price should the sale proceed. If the customer decides not to proceed with the purchase for any reason, the £250 reservation deposit is non-refundable, as it compensates Dragon Vans Ltd for administrative costs and lost marketing opportunities during the reservation period. Dragon Vans Ltd reserves the right to refund the reservation deposit at its sole discretion.
Vehicle Sourcing Service
Where a customer instructs Dragon Vans Ltd to source a vehicle that is not currently in stock, a minimum deposit of £1,000 plus VAT is required before any sourcing activity commences. The sourcing deposit covers time, expertise, inspections, travel, administration, procurement costs, and resources dedicated to locating and securing a suitable vehicle. Once Dragon Vans Ltd has commenced the sourcing process, the £1,000 plus VAT deposit becomes strictly non-refundable. If a suitable vehicle is sourced in accordance with the customer's agreed requirements and the customer subsequently decides not to proceed, the sourcing deposit remains non-refundable. Any balance of funds paid beyond the sourcing deposit may be refunded at Dragon Vans Ltd's discretion, subject to costs incurred.
Payment Terms
Full cleared payment must be received before any vehicle is released. Accepted payment methods may include bank transfer or other methods approved by Dragon Vans Ltd. We reserve the right to refuse certain payment methods and to request proof of identity, proof of address, or proof of funds where required. Ownership of the vehicle shall not transfer until all sums due have been paid in full and cleared.
Part Exchange Vehicles
Dragon Vans Ltd may accept customer vehicles in part exchange at its discretion. Part exchange valuations are based upon the information provided by the customer and our inspection of the vehicle. Customers must disclose all known faults, accident damage, outstanding finance, insurance claims, modifications, mileage discrepancies, warning lights, and any other material information. Should any undisclosed defects, finance agreements, mileage discrepancies, or material misrepresentations come to light after valuation or purchase, Dragon Vans Ltd reserves the right to revise the valuation, recover losses, or cancel the transaction. The customer warrants that they have legal title to any part exchange vehicle and authority to dispose of it.
Ex-Fleet Vehicles
Vehicles advertised or sold as ex-fleet vehicles may have been operated by multiple drivers during their service life. As a result, levels of wear and tear may be greater than those typically associated with privately owned vehicles of a similar age and mileage. While all vehicles are inspected and described to the best of our knowledge, customers acknowledge that ex-fleet vehicles may have experienced varying driving styles, usage patterns, and operating conditions. The presence of multiple previous users does not, in itself, indicate any defect or lack of maintenance, and customers are encouraged to satisfy themselves as to the vehicle's condition prior to purchase.
Finance Purchases
Vehicle purchases funded through a third-party finance provider remain subject to approval by the finance company. Dragon Vans Ltd cannot guarantee finance approval and accepts no liability for decisions made by finance providers. Finance agreements are subject to separate terms and conditions issued by the relevant lender.
Collection and Delivery
Risk in the vehicle passes to the customer upon collection or delivery. Customers are responsible for ensuring appropriate insurance cover is in place before driving the vehicle. Delivery dates are estimates only and may be affected by circumstances beyond our control. Dragon Vans Ltd shall not be liable for losses arising from delays in delivery.
Used Vehicle Condition
All used vehicles will exhibit wear and tear commensurate with their age, mileage, and previous use. Customers acknowledge that used vehicles may contain cosmetic imperfections, minor scratches, stone chips, interior wear, and other signs of normal use. Such characteristics shall not constitute faults or grounds for rejection where they are consistent with the vehicle's age and mileage.
Warranties
Any warranty provided with a vehicle will be detailed separately and may be subject to terms, conditions, exclusions, mileage limits, claim procedures, and maintenance requirements. Where a third-party warranty is supplied, claims must be made directly through the warranty provider in accordance with their terms. Warranty coverage does not replace or limit statutory consumer rights.
Returns and Consumer Rights
Consumers purchasing from Dragon Vans Ltd benefit from statutory rights under the Consumer Rights Act 2015 and other applicable legislation. If a vehicle develops a fault that was present or developing at the time of sale, consumers may be entitled to remedies including repair, replacement, price reduction, or rejection of the vehicle depending upon the circumstances and timing of the claim. Customers must notify Dragon Vans Ltd promptly upon discovering any issue and provide a reasonable opportunity for inspection and repair. Dragon Vans Ltd reserves the right to inspect and assess any alleged fault before agreeing to any remedy. Nothing in these Terms and Conditions seeks to exclude or restrict any statutory rights that cannot legally be excluded. We will charge £0.45 per mile when you choose to return a vehicle to us. The mileage charge will be deducted from any monies due back to you. Deductions will also be made for but not limited to; poor cleanliness, external damage, internal damage, mechanical damage whereby they were not present at the point of sale. By purchasing a vehicle from Dragon Vans you agree to these terms.
Distance Sales
Where a vehicle is purchased entirely online, by telephone, or without the customer physically inspecting the vehicle before purchase, additional consumer rights may apply under distance selling legislation. Customers should contact Dragon Vans Ltd for full details relating to their specific transaction.
Customer Responsibilities
Customers are responsible for ensuring that any vehicle purchased is suitable for their intended purpose. Customers should verify payload capacities, towing capacities, dimensions, emissions compliance, insurance costs, and any other operational requirements before purchase. Dragon Vans Ltd shall not be liable where a vehicle proves unsuitable for a purpose not expressly disclosed and agreed prior to sale.
Limitation of Liability
Dragon Vans Ltd shall not be liable for indirect, consequential, incidental, or business losses arising from the purchase or use of a vehicle for any reason.
Data Protection
Dragon Vans Ltd processes customer information in accordance with applicable data protection legislation and our Privacy Policy. Customer information may be used for vehicle sales, finance applications, warranty administration, legal compliance, fraud prevention, and customer service purposes.
Force Majeure
Dragon Vans Ltd shall not be liable for failure or delay in performing its obligations where such failure or delay arises from events beyond its reasonable control, including but not limited to severe weather, transport disruption, supplier issues, industrial action, governmental action, or technological failures.
Amendments
Dragon Vans Ltd reserves the right to amend these Terms and Conditions at any time. The version in force at the date of the transaction shall apply.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
